Terms of Service

West Side Tavern is a bar and grill located at 515 Gambia Ave, Wabasha, MN 55981. The website is operated on the tavern's behalf by ELEVARESTUDIO LLC, doing business as Elevare Studio. The tavern, not Elevare, is responsible for the food, merchandise, reservations, and service you receive.

Orders placed on this site are for pickup at the tavern unless we tell you otherwise. When you place an order, you're making a request that we confirm. We'll prepare your order for the pickup time shown, but times are estimates and can shift when we're busy.

Please pick up your order promptly. Food quality and food safety are time-sensitive, and we can't guarantee an order that sits waiting for a long time. You are responsible for the accuracy of the order details and contact information you provide, and for any allergies or dietary needs, which you should tell us about directly. If an item is unavailable after you order, we'll contact you to substitute, adjust, or refund it.

You can request a table or party reservation through the site. A request is not confirmed until we accept it; we'll be in touch to confirm.

We may ask parties of 8 or more for a small refundable hold deposit to reserve the table ($5 per guest). Any such deposit is applied to your tab when you dine with us. Smaller tables do not require a deposit.

If you need to cancel or change a reservation, please let us know as far ahead as you can. Deposits for parties that show up are applied to the bill; if you cancel with reasonable notice, we'll refund the deposit. No-shows or last-minute cancellations of large-party holds may forfeit the deposit to cover the tables we held for you. Because plans change, we handle these case by case, so reach out and talk to us.

Merchandise is sold subject to availability. We do our best to describe and picture items accurately, but colors and details may vary. Merch is typically picked up at the tavern.

If an item arrives damaged or is not what you ordered, contact us and we'll make it right with an exchange or refund. For other returns, reach out and we'll work with you; unworn, unwashed items with tags are easiest for us to take back.

Prices, menu items, and merch shown on the site may change, and items may sell out or be unavailable. The price that applies is the one shown at the time your order is confirmed. We work to keep everything accurate, but if an obvious error appears (for example, a clearly wrong price), we may correct it and let you cancel.

When we offer online payment or deposits, they are processed securely by our payment processor, Stripe. By paying, you authorize the charge shown at checkout. Refunds, when they apply, are issued to the original payment method.

West Side Tavern serves alcohol and is a 21-and-over establishment. Valid ID is required to be served alcohol, and we reserve the right to refuse service in accordance with the law and responsible-service practices. Nothing on this site is an offer to sell alcohol to anyone under 21.

Please use the site honestly and lawfully. Don't submit false orders or reservations, don't attempt to interfere with or break the site, and don't use it in any way that harms the tavern or other guests.

The West Side Tavern name, logo, menu, photos, and site content belong to the tavern (or are used with permission) and are protected by intellectual property laws. Please don't copy or reuse them without our permission.

The site is provided "as is." We do our best to keep it accurate and available, but we don't guarantee it will always be error-free or uninterrupted.

To the fullest extent allowed by law, West Side Tavern and Elevare Studio LLC are not liable for indirect, incidental, or consequential damages arising from your use of the site or from an order or reservation. Nothing in these terms limits any liability that cannot be limited under law, including for personal injury caused by negligence or for anything else the law does not permit us to exclude. Where liability is permitted to be limited, our total liability is limited to the amount you paid for the order or deposit at issue.

These terms are governed by the laws of the State of Minnesota, without regard to its conflict-of-laws rules. Any dispute relating to the site, an order, or a reservation will be handled in the courts located in Minnesota.

We may update these terms from time to time. The version in effect is the one posted here, with the effective date shown at the top. Continuing to use the site after a change means you accept the updated terms.
